Mediation is a voluntary process in which the parties to a dispute have an opportunity to discuss their differences and arrive at a resolution with the help of a trained and neutral mediator.
With the help of a neutral mediator with airing of past grievances and emotional obstacles the parties have the opportunity to preserve or restore relationships that may threaten the viability of the business.
A consulting attorney can act as your negotiation coach in addition to giving you specific advice for your legal position. In addition, the consulting attorney can review your settlement or separation agreement that results from the mediation.
Family Law issues can arise when creating, planning, or managing interactions between people who are related to each other. Making decisions in these cases can be challenging and stressful because the relationships have such great importance to the people involved.
In divorce mediation couples determine their own solutions for resolving the issues that must be addressed in their divorce. Couples work with a trained mediator in a non-adversarial setting to discuss their differences and identify solutions.
Mediation is a voluntary process in which the parties to a dispute have an opportunity to discuss their differences and arrive at a resolution with the help of a mediator. The mediator is a trained neutral who role is to facilitate the discussion so that the parties can express their viewpoints, needs, and preferences. The mediator does not decide who is right or wrong and does not provide legal advice. The mediation process is a way for the parties to reveal the issues raised by their situation and to discover options that will enable them to resolve their differences. At the conclusion of a successful mediation, the parties will have agreed upon terms and conditions resolving the dispute.
Mediation allows parties to be the masters of their own conflict and its resolution. For that reason mediation may be particularly appropriate for situations where great value is placed on relationships, history, and the effects of the conflict (and its resolution) on others. These situations typically include divorce, separation, custody, child support and parenting as well as closely held and family business disputes, and disputes between long-standing business or trading partners. Non-adversarial resolution of these kinds of disputes can preserve relationships even as their character may change and increase the possibility of a brighter post-dispute future.
